Re: Approving of Rules and Regulations


Pursuant to the approval of the revised structure of “National Water Committee” in accordance to the Resolution #98 on “Structure of the Commission of Government of Mongolia, Committee, National Counsel, and Working Division” of the Government of Mongolia dated on 20 October 2012, it is hereby RESOLVED to approve rules and regulations of the Committee as Attachment.

One. General Provision

1.1          The purpose of this rules and regulations is to determine roles and responsibilities and objectives of the National Water Committee.

1.2          The main role of the National Water Committee (hereinafter referred as “National Committee”) is to protect Mongolian water resources from deficiency and contamination, appropriately utilize potential resources, coordinate intersectors on water issues, provide consolidated management and to monitor the implementation of the National Water Program. 

1.3          National Committee shall abide by the principles to respect the laws, be open and transparent. 

Two. Roles and Responsibilities of the National Committee

2.1       National committee shall exercise the following roles and responsibilities in addition to the specified roles in article 9.1.5 of the Law on Water:

2.1.1 Coordinate and regulate activities of state administration organizations in charge of water and urban and rural water supply and sewerage system;

2.1.2 Elaborate water sector structure and monitoring mechanism, establish a system where utilizing individuals in charge of protecting and bearing responsibilities and regulate issues in regard to creating condition to provide sustainable access to water supply to population and industry;


                2.1.3 Put monitoring to ensure the implementation of the integrated management plan of the state water resources;


                   2.1.4 Develop a mechanism to finance activities to increase the value of water, protect and increase resources and conduct policy regulation among inter sectors to reimburse the costs occurred from conducting water survey with the state budget.

                   2.1.5 Protect underground fresh water sources, origin and water area where river and stream flow is created by taking in state and local specially protected areas, organize activities to plan actions to limit entity activities to operate in lake basin areas with large fresh water resources and ensure the implementation the action plan;

2.1.6 Intensify activities to introduce management structure of water basin and conduct policy regulation among inter sectors by not issuing prevalent rights to one of the utilizing parties;


2.1.7 Introduce efficient water utilization and new technology, increase the efficiency of water utilization, and provide appreciatable policy environment for by not allowing to use the underground water for drinking to the irrigation nor the drinking water for producing non-food industrial sectors, purify wastewater by advanced technology and support the re-use of purified water and grey water;


2.1.8 Establish an appropriate system allowing aimag and soums to equally receive the final benefits resulted from the use of water resources at regional and river basins areas;

2.1.9 Appropriately utilize river and lake water for energy, health resort, sports and tourism purposes within the renewable natural capacity and increase economic benefits of renewable water resources;

2.1.10 Develop solutions for water supply of the population and industry by economizing the part of the surface water for entity use to increase;

2.1.11  Develop water safety plan and get approval;

2.1.12 Introduce programme to purify wastewater at industries and entities meeting wastewater standard on marginal amount of effluent wastes into the environment 

2.1.13 Increase participation of water sector science organizations and NGOs;

2.1.14 Monitor the activities on providing methodological management to make configuration at river flow, create water accumulation, transfer and utilize, and develop water distribution network of Mongolia;

2.1.15 Develop proposals for making an agreement with neighbor countries on the border water, revising the agreement and entering into international organizations those dealing with the water as a member country;

2.1.16 Within the framework of the protection of water resources and research, provide integrated coordination for supporting international relations and foreign investment;

Three. Managemetn Structure of the National Committee

3.1.        The Government of Mongola shall approve the management structure of the National committee and the Prime Minister of Mongolia shall apppoint the secretary of the National Committee.

3.2.        National Committee shall be composed of members including representatives from the State Administration Central Organizations in charge of sectors including environment and green development; defense; infrastructure; foreign relations; finance; economy; industry and agriculture; mining; energy; health; road and transportation; education and science as well as the National Security Council of Mongolia and Water Service Organiziations.

3.3          Members of the National Committee shall be responsible for the water policy coordination of the sector on behalf of the committee.

3.4          Secretary of the National Committee shall be responsible for day-to-day implementation of the Committee.

3.5          “Meeting” shall be a main activity form of the National Committee. National Committee shall issue a resolution regarding the discussed issues.

3.6          According to the decision of the National Committee, the project team and working division can be established from the officers at the relevant ministries, scientists and NGO representatives.

3.7          Meeting shall be chaired by the Director of the National Committee and meeting discipline shall be discussed and approved at the meeting of the National Committee.

3.8          National Committee shall establish its branch commitees in aimags and the capital city. Respective aimag Governors and Mayor shall be the chief of branches of the National Committee. Branch chief shall approve the management structure and rules and regulations of the branch activities.

3.9          Branch committee shall report to the National committee.

Four. Working Group

4.1          Day-to-day activiteis of the National Committee shall be executed by the Division (hereinafter referred as “Working Division”).

4.2          Working Division shall consist of the director and official employees.

4.3          Working Division Director shall be the Secretary of the National Committee.

4.4          Working Division Director shall make orders within in his/her given rights.

4.5          Working Division Director shall execute the following roles and responsibilities:

4.5.1 Develop and get approval on National Committee’s annual work plan and organize actions to implement the plan;

4.5.2 Implement the Human Resource Management of the Working Division and recruit, lay out and issue salary and bonus according to articles stated in the law and regulations;

4.5.3 Inquire reports, information, statistical data and reference required for the National Committee activities from relevant organizations and build information data;

4.5.4 Ensure the preparation of organizing the National Committee meeting, officialize decisions of the National Committee and submit the decisions to the related organizations;

4.5.5  Coordinate the public awareness activities in order to promote the actions of the National


4.6          Working Division shall apply the stamp and official letter forms made in accordance with the rules and have an account at the State fund. Working Division shall have its symbol that defines the specifics of its work.

4.7          The activities of the National Committee shall be financed by the State Budget.

Five. Other

5.1       The National Committee shall make annual and semi-annual work plans, consolidate reports of the relevant ministries and sectoral committees and submit to the Government of Mongolia in the first quarter of the year.
